MARBLE BAR CASE.
WELLINGTON, August 22. Mr Hiddell, S.M., to-day heard an application to strike out the nam© of the Eon. <*. W. Russell (Minister of Public , Health) in the Marble Bar case heard on | August 14. Mr P. S. Macassey, who I made the application, said the order cicsing the premises was not made by tlio Minister,-but by tho District Health Officer. Assuming that order was ultra vires plaintiff had no right of action, as he should liave ignored an illegal order. The order
was perfeofcly valid, as it was necessary to prevent the spread of the epidemic. His Worship granted the-'application, and ordered that the Minister's name be struck out.
