COMENSATION CLAIM.
HASTINGS, August 9. 'i'ho hearing of the claim for £750 compensation made by Sarah Hurst against the Hastings Borough Council for alleged depreciation in the value of her property in Eastbourne street, caused by the erection of the borough electric power and pumping station on an adjoining section, was resumed this morning before his Honor the Chief Justice (Sir Robert Stout), Messrs V. Dunnett and H. A. Mossman acting as assessors for the claimant and respondent respectively. Sir John Findlay, K.C.. with him Mr J. Cl. Pcrsse, appeared for the plaintiff, and the borough solicitor (Mr E. 11. Williams) with Mr J. Murdoch for the defendant. After lengthy evidence had been taken his Honor intimated that it had been suggested by the assessors, and he concurred, that the parties should endeavour to arrange a settlement by the council acquiring the property at a figure fixed by the assessors. This course was agreed to, and the court adjourned to inspect the property. On resuming, the Chief Justice stated that it iiad been atrreed that the council should purchase the property, and the price had been fixed by the assessors at £BSO, and the amount of compensation for disturbance at £lO. The council would also pay costs (£6O). The assessor’s fee was fixed at £8 8s; each party to pay its own assessors.
