ALLEGED PERJURY.
A CONVICTION’ QUASHED. WELLINGTON, July 30. A point arising out of a perjury case was decided by the Court of Appeal today. The facts were that Samuel Francis A.itken was found guilty of falsely swearing that lie was a marred man when ho applied for o. publican’s license. The Chief Justice reserved for the Appeal Court’s decis : on the question as to whether the magistrate who heard the application under section 85 of the Licensing Act acted in his iud’ciai capacity, sentence being deferred in the meantime. The court held that the magistrate had not acted in his judicial capacity, and quashed the conviction.
