COURT OF APPEAL.
AN EDUCATION RESERVE. WELLINGTON, October 28. Tn the appeal case the Education Board of Auckland v. the Public Trustee, afreeting the claim to a block of land in Auckland said to be worth a quarter of a million sterling, the Appeal Court (Mr Justice Edwards dissenting) gave judgment that the board had no claim, but that the Public Trustee held the lands upon; trusts defined by law for educational purposes in tlie province of Auckland. The court considered that the trusts could not be properly carried out without assistance, either from the Legislature or under a scheme approved by the court. Costs on the highest scale were allowed both the board and the Public Trustee, to be paid out ai tKa l.nist fundfl.
