ACTION FOB DAMAGES. HASTINGS, October 1.
Mr M'Carthy, S.M., gave his reserved judgment in the case England v. O'Neil, a claim, for £150 damages sustained in consequence of defendant conducting his business as pork butcher so as to create a nuisance. Plaintiff occupied the upstairs part of the building, in which he carried on the business of dining rooms. Defendant was on the ground floor. He manufactured f-mall goods in connection
with his trade. Plaintiff's health broke down through the offensive smdl, and he j gave up the business. 'The magiatiate j said that with every care and fkili used, and without actual proof of injury to . health, the defendant would be liable. 1 Judgment for the plaintiff for £100., and ! costs (£l4 8s).
