-, ANr-.IMEOBPANT . &UUING. 'j WmiiilNaTONi ;, Odtdber 12. An interesting decision in a , compensa* tion case was to-day filed by the ATbi- ' tration -Court. The - claimant (Begalado ' Kells) was employed discharging coal from ! the steamer Rakanoa at Napier break-,] water on March 28. He started work afcl / 8 a.m., and- continued, to work till noon,*j "when- he stopped for the usual dinner I , "] hour. He went home, for his meal, andQ while returning his ■. bicycle skidded and! , he met with an accident, which, it was\ claimed, arose out of and '-in the coursa of his employment by the Union Com- j pany. The claim was therefore made for; compensation for the six weeks he was ; incapacitated. The court stated that there \ was no authority for saying that when a ' worker -left> his employer's premises during a meal hour for the purpose -of obtaining, a meal at a place selected by himself the employment most be treated as continuing, during such meal hour. The court thought that in such circumstances employment should ' be treated as having been suspended during the absence of the worker from the place where work was being done. The claim was dismissed.
