SHIPPING LITE STOCK.
DAMAGES FOR DELAY. (Fbom Oub Own Cobbespondent.) AUCKLAND, December 2. A case of considerable interest to cattle owners and shipping companies occupied the attention of Mr R. W. Dyer; S.M., at Helensville last week. Messrs Finlayson Bros., farmers, near "Dargaville, sued the Kaipara Steamship Company for £92 damages for loss of condition and decrease in value of certain store cattle through being kept by the shipping company an unreasonable- time in punts on a voyage from Aratapu to Heleneville. Mr M. M'Gregor conducted plaintiff's ca6e and Mr C. J. Parr appeared for the shipping company. The plaintiffs' caee was • that the cattle, after being put in punts at Aratapu, were left all night moored to Te Kopuru wharf without food or water, and thua a voyage which ordinarily takes only seven hours was on this occasion extended to 22 hours. Tbe cattle suffered and were depreciated in value. The company contended that the voyage was delayed by bad weather, and, further, that in any case the damages claimed were excessive. His Worship said he was not satisfied that the weather was bad, 'and' held that the shipping 1 company must deliver within a reasonable time. He thought the damages claimed were excessive, and awarded the sum of £24 12s and costs.
