THE M'CLUSKY CASE.

At a special meeting of the committpe of the Auckland Racing Club the M'Clu^kie case- was reopened by the receipt of * letter from the chairman of the Racing Conference (Sir George Clifford), bearing on the matter. After consideration it was decided to send the following letter to the secretary (Mr H. H. Hayr) of the Avondale Jockey Club: — Sir,— Referring to the appeal of your committ&s touching the disqualification of M'Cltisky, while my committee do not admit their action under Rule 141 to be subject to anneal, in deference to the suggestion of the chairman of th« conference I am directed to intimate to you: 1. That the provisioas of Rule 14-1 must be substantially complied with before the question of the endorsement of th-e disqualification can Ibe concidered. 2. That it is essential in this ease my committee byi furnished with a description of tht occurrence which grave rise to the disqualification, together with the statements- {signed} of such of your ste.warcs who witnessed it or other grounds, upon wh : ch action was taken, and also the explanation (if any) of. the person charged. In the opinion of my committee it is not sufficient to supply a copy of the resolution, and state, as in your letter of the 2Sth April, "no 'evidence was taken, the inquiry being- taken up by the stewards themselves, and, therefore, was decided on a question of fact." 3. That as a misunderstanding seems to have existed, it is still open to your stewards, subject, tc a compliance with ths requirements abovs. to have the question of the endorsement of their action dealt with by my committee— Wm. Porcival, Secretary. A.R C.
