Friday, May J9. (Before his Honor Mr Justice Williams.) BE JAKES MAItSUALI,. A creditor's petition for adjudication. — Mr 3. A. Cook appealed in support of the petitioning creditor, Dalgety and Co. Mr Cook said the petition was made on the ground that the debtor had committed an act of bankruptcy by departing from his duelling «md absenting himself altogether, having a-p-B?aire:ntly absconded from this part of the colony. His Honor would remember that about a fortnightly previously he (Mr Oook) anade an ordter for substituted service of the petition, ordering that it be advertised once in the New Zealand Gazette and once in the local paper, and that had been complied with. Th«re had been no notice of any appearance on the part of the debtor. The affidavits fully set out the whole ease — namely, that Marshall was «■ farmer on the Barnego Settlement. He Hold fell his stock in January, and put up his place Sot sftle (but it was not sold), «md, hafring disposed of his horses in Dunedin, he disa.ppe«ed, leaving his crop standing. The petitioning ci«ditor (Dalgety and Co.) cut th& crop for the Jbenefit of aU-'conceraetb Counsel asked if in -ihe face of- the -affidavits any evidence was required. " ' «...
