INVERCARGILL, March 8. At the Supreme Court Raymond and Co. sued Friedlander Bros., Ashburton, for £421 damages for alleged breach of contract for the purchase of oats. Plaintiff's case was in effect that, in 1903, plaintiffs contracted with defendants for the supply of 5000 sacks G grade oats in two lots, and on specific dates. The first consignment of 30C0 sacks was taken delivery of, but defendants would not take the balance, and plaintiffs sold them, the market price in the meantime having considerably dropped. Plaintiffs also sued for storage, interest, and special damages. Mr Justice Williams expressed the opinion that the ease should have been heard by an expert jury. The matter turned on the question of whether or not plaintiffs were in a position in July, 1903, to deliver sound oats. (It was a bad year in Southland.) Tho jury's answer was "Yes."
