July 30. Tbe case mentioned by me labt week, relating to the possession of St. Hiko, was heard beforo the local S.M., Mr H. li'yrc Kenny, on the 27th h>st. Messia Ske-.rctt a-'d Cooper appeared for plaintiff, and Mr Bunny for defendant. The facts were stolid briefly as follows :— ln Juno last Tate sent the horse to Peter?, who i* a trainer at the Lower Hutt, authoiisiug him to Btll it by auction. It was accordingly put up, but the reserve figure win not reached. Peters then trained the animal for the recent ■Wellington meeting, with the result that it won. On (he Biondsy following the races, Peters sold the hors-e to his son for .£SO, as that was the price which Tate li&d ssid in a telegram to the trainer that he would areept. Defendant said that when he told Tate of the tiun<saotion, the latter did not ask to whom the horse had been sold, nor how much it fetched. T.tte, however, swore that he did attempt to get this information, but it waa refused. lie denied that he was not sober at the time. Plaintiff did not know to whom his horse had been sold nor for what price till it was stated in court, and said that Peters had no light to sell it without consulting him. The ovigiual authority was to sell the racer by auction, and that authoiity ended when the auction failed.
