■ ■ Auckland, August 11th. A religious monomaniac, named John Tyler, was arrested at Hamilton. He is under the belief that he haß performed miraculous cures on the sick, .and that he is being persecuted for so doing. He arrived in Auckland in February last from Napier, and has written letters to the Governments of New Zealand and Victoria and to the Queen asking for protection. A copy^ of the letter sent to the Queen was found on him, dated from Manawatu.

Mr Justice Richmond gave judgment to-day in Banco in the important insurance case, Bank of New South Wales v. The Royal Insurance Company, The.action arose on a , policy of insurance. The subject of insurance was a timber-mill, desoribed as the property of C. A. Hams, jun,, and the sum for which it was insured was L 1350. The Company elected to rebuild, and after a' lapse of time tenders were called for, and subsequently the Company pre a ferre'd to pay the amount of the policy, rather tharf rebuild. The Bank,* us mortgagees, held that' the, Company, having made its election, could not depart from it, and in default of the preniises being rebuilt sued for the value of the property injured; t ' which ; was Bet down at L 2850 in the pl^jntiffd' declaration! The'defendants demurred on tne . following grounds: — (1) That the declaration did not disclose any cause of action,' inasmuch as 'it did' not allege that at' the time of - the said election being made— to wit, on the 17th day of January, 1 1880— the plaintiffs had any insurabla interest in the property covered by the said insurance,. and without such interest the. said election. could i not be held binding on the Company ; (2) that the plaintiffs being mortgagees of the property, and the said policy only, covering their interest as such mortgagees, the 'election could not bind the defendants to reinstate without the consent; of the mortgagor, and such consent was not averred. (3) Tnat the insurance effected by the said policy was not an- insurance of the building per se, but only of the mortgagees' security thereon, and it was not averred that at the time of the said | election or at the commencement of this action the plaintiffs continued demnified and' their seourity unsatisfied. Mr Justice Richmond overruled the demurrer, giving defen-| dants 14 days' to plead on payment ,of ' the' cost of the demurrer, otherwise judgment' for the plaintiffs. , ,'At the half-yearly meeting of the Bay of Islands Coal Company, the report showed the ,Bftle3 of coal to be 25,277 tons for the half-year, being an increase of 1000 tons ' for' the 12 months. A dividend of 7b per cent, da the capital was declared, and L 1069 carried to the reserve fund. James Fraser Bell was charged at the Court thißJmornißg with the falsification of the registration of birth 1 of a child. It appears that he married a woman named Annie Lydia, Haines, of Auckland, in 1&69, and went afterwards to Wellington to reside in 1877- A daughter of the; woman came out from England. Bell and his wife did not live happily together ; so j they separated, and the daugther took up , with 1 ' him at ( Wanganui. They then went to Patea ' together, , where they lived as husband and wife. They afterwards came to New Plymouth, where she gave birth to a male child. Bell registered the child as his legitimate offspring. Hence the prosecution. The girl, who is only 18 years of 'age, in her evidence said she left her home because her. mother wished her to go on the streets; also that Bell cued for her, and she went to live with him. Her mother was not Bell's wife, as she told her Bhe ■'was married to another man. „ >

Napier, August 11th. 1 The Education Board will not have to make reductions in expenditure in consequence of the reduction of the grant. Salaries, bonuses, &c. will continue •to be pai.d as heretofore, the Board having so husbanded its resources. It has L3OOO invested on fixed deposits. Wellington, August 11th. His Excellency's racehorses were landed in excellent condition from the Wakatipu this morning. It is understood that notwithstanding Sir Hercules' departure from the Colony his, horses will perform at the Canterbury meeting. Christchubch, August 11th.
