Norman v. Dyer.
Norman (a German) sued J. W. Dyer, the Licensee of the Royal Hotel, for 255., being for one week's wages as ostler. The defendant pled that plaintiff was engaged for 2 months, and that he left his service without cause. The plaintiff, on the contrary, asserted that the engagement was by the week. The magistrate held that on plaintiffs own shewing he was a weekly servant and consequently a weeks notice on the part of either master or servant was necessary to terminate the engagement. The case was dismissed.
