Messrs Macalister Bros., solicitors, i wrote with reference to the names of ! two councillors whose names did not I appear |m the 1908/09 roll of the I county ; that reading sections 59, 84, and sub-section 1 of 85 pf the Counties Act, 1886, together, they were ot opinion that the seats of the two councillors had become vacant even without uny resignation being received, as they were prohibited from acting as councillors according to sec- ion 87 The solicitors further gave opinion that new councillors must be elected to fill the vacancies, m accordance with sub-section 1 of section 89 of tinLocal Elections Act, 1904, and consequently tbe council could not continue till the, general election of councillors m November with the two seats vacant. • — Letter received? WELCOME FROM. WALLACE C©UN*IY. John Edmond offered to supply flag , for the council's representation at the visit of the American fleet, at a cost of £2 7s 6d. The Town Clerk, Invereargill, wrote, that the combined boroughs had pro- 1 cured a flag 30ft x 7ft at a cost of £9/ He referred the council to Mr H. Cunniugham, Invereargill, who would supply a flag of dimensions suggested by Premier at •froih'&F to £8 10s. The Southland County clerk advised that they had no communication on the subject. The chairman: As . this was a matter for prompt attention, he had authorised the clerk to order a flag at a cost of £2 78 6d. — Action confirmed. SUGGESTED AMENDMENT PUBLIC WORKS ACT. The Waimate County Council asked the co-operation of the council m having the Public Works Act amended to enable public bodies to call upon owners of land proposed to be taken for public works to state compensation to be claimed, and also providing for authority for the Compensation Court to valuation to be paid. Also for provision for payment to, owner of costs incurred ill the event of the local authority deciding to abandon the proposal to take land. i Cr Hirst thought the, act as it stood I met their < wants. He did not see much necessity for the proposed amendment. On tha motion of Cr. Affleck the tetter was received. GORBE AT DRUMMOND. ' G. Toogood, Etal Creek, asked permission to shift a gate on h : s roadway to a point near the homestead.- - Granted. GATE ON BOADLINE. ' E. W. Smoothby, Papatotara, asked permission to erect a gateway on roadline between property of ■Mr W. J. Erskine and his own, so that he or his neigh boujs "could muster sheep pn i-he roadline, and keep down ragwort. Cr-fKing said as a matter of fact the gate had been there for the past 12 and was shut every time he visited the place. There was no objection to the gate that he knew of,§and application having been- made, applicants would now have to comply with the regulatkns and advertise the fencing of the roadway. Louis Garden, Orepuki, asked for a refund- of £1 2s 6d paid for certificate of title over area contained m a closed road acquired by him, but which was not an original road, but surveyed at the instance of the council. G Hodgetts, Te Tua, reminded the council of state of water tables and bridge opposite block 18, Longwood, and hoped the engineer would be along soon, or he would not be able ;i tp -get, as the drain at present was coming down the middle of the road. . Cr Hirst : The surfaceman had instructions to see to the water-tables. He thought the letter was m bad taste, and had no doubt that when the surfaceman got to the place, the work would be done. BETTER ROAD WANTED. M. O'Connell, Mangarua, asked! that 60 chains of forming ' and gravelling on roadline opposite sections 16 and 18, block 15- would meet the wants of the locality for long time, v ahd he asked that it be done, as the I road at present was impassable. — To bo informed that the request* will be attended to when the season approaches for doing such work. . road had been stopped, and that something must be done, and speedily. Cr Hirst, m . xplanation, said he had received a message from Round Hill '■hat the company had ceased, carrying goods and passengers, and at his request the attorney for the company had agreed to continue the tramway traffic, hut now this had been stopped by the new manager. PATENT BIRD TRAPS. A. M. Grainger, Dunedin, asked if tho council wanted any of his patent bird traps, by the use of which he stated the council would have little^ trouble with tbe" bird nuisance. The traps could be relied on to catch the birds, and were no fraud ; they would trap right through the season. A discussion arose about the utility of the trap the council at present had Cr Hirst sayihg that he had heard of two boys drawing £97 for small birds from the use pf the trap. Inquiry to 1 be made as to efficacy of Grainger's trap. : ' BED FUNNEL " POISONED WHEAT. Tames Chemical Stores Company offered to supply "Red Funnel* poisoned wheat for birds— Received. GILTRAp's ROAD. Cr Affleck reported that the engineer and he bad inspected the road, and' recommended the expenditure of v £10 to make the road .viable. A WAIMATDKU MATTER.! Cr Fraser moved, that the offer of ; Robey and Sutherland of £2 10s per acre for roadline at Waimatuku accepted provided that the Road Engmeer has no objections.
