BREACH OF PROBATION ORDER.

At the Magistrate's Court yesterday J. A. Hill (Mr J. R. Lundon) was charged with failing to comply with the terms of4ns probation order.

The case, as outlined by Senior Sergeant Woblmann, was that the defendant was admitted to six months' probation ih 1910.- Before the term expired, he was brought up on two charges tor obtaining goods under false pretences, and sentenced to four months* imprisonment. During that time, the term of, his probation order expired. On being released, he was again brought before the Court at Thames, for tailing to comply with the original order, and then admitted to a further three months' probation, to enable him to comply with the original order and make restitution. He then went to Australia, and added three more convictions'to his-record.

The defence submitted by Lundon was that the original order had expired whilst defendant was in gaol; therefore, he could not be prosecuted for failing t!o comply with the first order, because while tie was in gaol he was complying, the gaoler being the probationary officer.

The case was adjourned tor two months, to enable the defendant to pay over the balance owing on original
