BENEFITS UNDER WILL
FAMILY’S CLAIM ESTABLISHED PA CHRISTCHURCH, Apl. 15. In a reserved decision in the Supreme Court, Mr Justice Northcroft held that the daughter and two sons of the late Samuel Smith, of Cust, had established that there was a promise by their father that if they worked for him they would get more than wages at his death. No provision was made for them in his will. His Honor awarded Mrs Mabel Gartery £1250, and William Smith and Ronald Smith £1750 each. His Honor said that the will made in 1937 did make dispositions favourable to the plaintiffs, but thereafter other drafts will reduce these benefits until the final will" excluded them.
