GRANTING OF DECREE
UPHELD BY APPEAL COURT (P.A.) WELLINGTON, July 8.. The Court of Appeal to-day upheld the judgment of the'Supreme Court in granting a decree nisi to a husband. The appeal was from a decision of the Supreme Court in Wellington in November, 1945, granting a decree nisi in divorce to Lance Errol Emery, of Masterton, a printer, against his wife, Ivy Ilene Emery, on the grounds that the parties entered into a separation deed in 1932 and that such deed was still in full force and effect. The wife alleged in her answer to the proceedings that the separation was the result of the husband’s persistent cruelty and neglect. After hearing evidence for both parties, the Supreme Court granted a decree in favour of the husband as petitioner, and the wife appealed against this decision on the grounds that it was erroneous in fact and law.
