MAGISTRATE'S COURT

Tuesday, October 3 (Before Mr J. R.. Bartholomew, S.M.) , Undefended Cases Judgment by default was awarded the plaintiffs in the following cases:— John Mill and Co., Ltd. v. J. Thornton Scott (Invercargill), claim £2 lis for goods supplied, with costs (£1 5s 6d); Brown Ewing and Co., Ltd. v. N. Day, claim £1 Is 6d for goods supplied, with costs (12s); Samuel Vanes and Janet Vanes v, James Myles Ford (Invercargill), claim £2l 6s for damage to motor car, with costs (£4 12s 6d); Hogg and Co., Ltd. v. Albert Kenneth Adamson, claim £3l 5s 3d for materials supplied, with costs (£4 4s 6d). A Claim Succeeds His Worship delivered his reserved decision in the case in which the owner of three shops in Princes street, Kate Thompson (Amberley), proceeded against George Joseph Errington and Charles H. Tucker and Co claiming damages amounting to £66 16s Bd. The accident occurred when a car driven by Errington came into collision with a lorry owned by Tucker and Co., and then mounted the footpath near the intersection of Dowling and Princes streets, crashed into a veranda post, and damaged shops occupied by W J. Thomson (seedsman) Annie ' and Mary Mclntyre (confectioners), and S. E. Ferguson, Ltd. (opticians) Mr C. J. Rawlinson appeared for the plaintiff Mr E. J Anderson represented the defendant Errington and Mr A N. Hagsitt the defendant. Tucker and Co Mr A. J,H Jeavons watched proceedings on behalf of the occuniers of the three shops.—After reviewing the case his Worship said it was auite clear that the weight of evidence lay only in one direction. Judgment for the amount claimed with costs (£ls 13s 9d> must be given against Errington. ihe magistrate also awarded Tucker and Co. costs amounting to £2l °s so. against the plaintiff, and said that the latter should add these on to the costs to be claimed from Errington.
