APPEAL BY COMPANY
WINDING-UP DISALLOWED (Per United Press Association) WELLINGTON, June 7. Judgment was delivered this afternoon in an appeal from an order of Mr Justice Blair for the windingup of F. Hall and Sons, Ltd., made at Gisborne on December 5, 1938. The case was heard in the Court of Appeal on April 18, 19, and 20 of this year. The court, in its judgment, holds that it was not just and equitable that the company should be wound up, and allowed Ihe appeal. Costs on the middle scale as from a distance were allowed to the appellant. F. T. Hall. This decision represents a further phase of the extensive litigation between F. T. Hall, of Gisborne, and the Guardian, Trust, and Executors Company of New Zealand. The matter concerns on order made by Mr Justice Blair at Gisborne on December 5, 1938, for the winding up of F. Hall and Sons, Ltd., a painting and paperhanging company, on the application of the Guardian Trust Company, the administrator under part 4 of the Administration Act. of the estate of Frederick Hall (deceased), which estate held a majority of shares in F. Hall and Sons, Ltd. It was from this order that F. T. Hall, holder of the balance of the shares, appealed.
