. .». WOMAN'S CASE AGAINST CAR OWNER HUSBAND KILLED IN ACCIDENT (Per United Press Association) WELLINGTON, Oct. 26. Before the Chief Justice (Sir Michael Myers), the hearing of a claim for £3OOO damages was commenced in the Supreme Court to-day. Ada Payne was the plaintiff, whose husband, Henry Payne, was struck and killed on the Hutt road on the night of June 21 by a car owned by Dunstan John Burney. a glass merchant, of Wellington. , ~ A It was alleged that the accident was due to the negligence of a mechanic,, who was driving with the owner's consent. . The defence was that if it could be proved that Payne met his death as a result of the collision, it was contributed to by his negligence in crossing the road.
