CLAIM AND COUNTER-CLAIM DECISION RESERVED Further evidence was heard in the Magistrate’s Court yesterday before Mr J. R. Bartholomew, S.M., in the case in which lan Archibald Ashworth, who was represented by Mr J. C. Robertson, proceeded against Edward Forsyth Lloyd (Mr C. M. Barnett) for £47 4s 6d damages. The claim arose out of an accident at the corner of Maitland and Princes streets on January 24, when a collision occurred between a car driven by the plaintiff and a milk lorry driven by the defendant. The plaintiff alleged that the accident was the result of negligence on the part of the defendant in that he drove his van at an excessive speed, failed to give way to traffic approaching on the right, failed to keep his vehicle under proper control and did not keep a proper look out or apply his brakes to avoid a collision. Tire defendant entered a counterclaim for £ 150 9s 3d, alleging that the plaintiff had been negligent in that he drove negligently and recklessly, failed to keep his car under control, failed to take a wide sweep to the left when turning into Princes street, failed to keep his vehicle in good mechanical order and carried too many passengers in his car, with the result that he did not have if under proper control. After the evidence of six more witnesses for the defence had been heard, the magistrate said he would take time to consider his decision.
