THE STIRLING LADY CASE

APPEAL UPHELD The appeal of Mrs M. Clark, of Winton, the owner of the pacer Stirling Lady, against the decision of the New Zealand Trotting Association and of the Wyndham Trotting Club has been upheld by the judges (Messrs B. S. Irwin, A. C. Hanlon, and J. S. . Sinclair) appointed by the New Zealand Trotting Conference. In the race concerned, in which Stirling Lady was placed first and Pot Luck second, it was alleged that in the. run down the straight Stirling Lady bored into the other trotter, and the stipendiary steward in attendance at the meeting took up the matter. After a lengthy hearing the Judicial Committee of the club reversed the judge's placing?, holding that Stirling Lady did interfere with Pot Mrs Clark appealed to the Trotting Association against the decision of the club, but the club's action was upheld. She thereupon lodged an appeal with the Trotting Conference, which appointed the above judges to hear the case. The effect of the decision of the judges is to reverse the decision of the Trotting Association and of the Wyndham Club. In giving their decision the judges held that the proceedinps which purported to be an inquiry by the Wyndham Trotting Club, upon an objection made by the stipendiary steward, were irregular and ultra vires. Quite apart from that conclusion the judges held that the appellant could have succeeded on other grounds. An order was made for the return to the appellant of the deposits made by her in connection with the appeals and the question of costs was referred to the Trotting Conference.
