MAREO CASE

HEARING OF THE APPEAL DATE FIXED BY COURT (Pek United Press Association) WELLINGTON, March 9. The Court of Appeal Bench, consisting of the Chief Justice (Sir Michael Myers) and Mr Justice Reed? Mr Justice Blair, and Mr Justice Kennedy, this morning concluded fixtures for the Court of Appeal and the Full Court at the March sessions. It fixed the date of the hearing of the Mareo appeal for March 23. ' Mr H. F. O’Leary, applying for a fixture in this case, said that, as yet, it had been impossible to prepare for the trial. The Crown had agreed to print the case, which was of considerable assistance, as there were about 200 pages of evidence, and this, with exhibits, would mean a printed case of 250 pages. It was estimated- that the hearing of the application would taken three days. Mr Taylor, of the Crown Law Office, said the Justice Department would see to the printing, but its action in doing so was not to be taken as a precedent. It was being done merely because it was understood that Mareo had no funds whatsoever. Mr A. H. Johnston, K.C. (Auckland) is appearing for the Crown, Other cases of interest sot down for hearing include that of Ritchie versus Ridd, a Wanganui breach of promise action, for March 20, and another phase of the case, Lysnar versus the National Bank of New Zealand, Limited, is to be heard on March 27; when Lysnar intends to appeal from the judgment of Mr Justice Blair of October 30, in which damages in the action were fixed.
