Mr .Justice Rich said it would he better to allow, the State Full Court to determine .the question hrst, and if either' party was then dissatisned it could ask. the High Court for special leave-to appeal. The Australian Jockey; Club.-wrote to Rufus Naylor requesting him to attend an inquiry under rule 9 to show cause why he should not-be excluded ; from,the Randwick- racecourse on the ground that-he was-not d' desirable person to admit. JSaylor then- sought an ex parte injunction, to restrain the A.J.C. Committee from procee:ding with the inquiry or coming to any decision under that rule, which he claimed was invalid. -Mr- Justice: Street, .in. the Equity Court, dismissed Naylof 's .application for an interim in junction, restraining the Australian Jockey-Club; from acting under : the rule.
