The fact that a driver is dazzled by the headlights of an oncoming car does not, in France, relieve him of responsibility for any accident that he may cause as a result of his inability to see properly. This principle was insisted upon by a Paris “jnge de pais” in a case recently before him. It is based on the mo&t important rule of the French “ Code de la Kouto ” —that a motorist must, at all times, bo completely the master of his vehicle. The magistrate, therefore, concluded that the moment the man at the wheel, found himself blinded ho should stop. In the case in question the claim of the defendant that he was on the right side of the road and that he was travelling at a moderate speed, was not disputed. Just before entering a village on the outskirts of Paris another car travelling in the opposite direction came round a bend with headlights full on, with the result that the first driver failed to see a pedestrian who was walking in the roadway immediately in front of him, and ran him down.
