"Adoption.”—The effect of an adoption order Is that the child adopted shall for all purposes, civil and criminal, and as regards all legal and equitable liabilities, rights, benefits, privileges, and consequences of the natural relation of parent and child, be deemed In law to be the child born in lawful wedlock of the adopting parent. It is, however, provided by the Infants Act, 1908, that the adopted child shall not by reason of the adoption acquire any right title, or Interest In any property which would devolve on the children of the adopting parent by virtue of any will prior to the date of the order of adoption unless it Is expressly so stated in such will. If the will was made later than the order of adoption the adopted child would appear to be entitled unless the will expressly provides otherwise. If, however, the will, as appears likely, was made prior to the order of adoption, then unless 1 the adopting parent has other children who become entitled to take under the will, the adopted child may still be entitled to take If the adoption took place prior to the date when the, shares of the children should have become vested. Its claim, however, would depend upon a provision of a statute which In this respect has not been judicially Interpreted and no confident opinion can therefore be expressed. It must be understood that the words of the will primarily govern the question, and the above must be read subject to them.
