George Muirhead Torrance (Mr, C. B. Barrowclough) proceeded against John Lament Ford (Mr E. J. Anderson), claiming £25 5s damages arising out of a collision between the plaintiff’s car and a milk cart driven by the defendant. The plaintiff stated that he was proceeding along Filleul street when the defendant, by his servant, negligently drove and managed a horse and milk cart, proceeding down Cargill street, so that at the intersection of Cargill street and Filleul street he collided with the plaintiff’s car. The plaintiff therefore claimed £2O 5s for cost of repairs to the car, and £5 for loss of the usp of the car.—The defendant entered a counter-claim for £lO 12s, consisting of £lO damages to the milk -cart and 12s for loss of milk. He alleged negligence on the part of the plaintiff's servant in that he approached an intersection at excessive speed, failed to keep a proper lookout, and failed to give warning of his approach.—After evidence along these lines had been taken the magistrate held that the defendant, in cutting the corner, had been principally responsible for the accident, and gave judgment for the plaintiff on the claim and the counter-claim, with court costs (£2 3s), witnesses’ expenses (£1 8d), and solicitor’s fee (£4 3s).
