PARKING OF CARS.

HEARING OF TEST CASE. THE REGULATIONS UPHELD. A tost case arising out of the prosecution of a number of motorists for leaving cars outside recognised parking areas not parallel with the kerb' was hoard before Mi' H. W. Bundle, S.M., at the City Police Court on Saturday morning. When the defendants first appeared before the court some days ago it was held that the regulation under which they were charged conflicted with a later regulation which states that cars parked on a grade must he left jn such a position that if they move of their own accord they will run against the kerb and stop. It was contended that this by-law could not be observed if cars were parked parallel with the kerb.

Mr H. E. Barrowclough appeared for the City Corporation, and Messrs E. J. Anderson, D. Solomon, and G. M. Lloyd represented the defendants.

Mr Barrowclough produced authorities showing that in the ease of two apparently conflicting regulations commonsense must be applied to reconcile them. If that was done in this case, he said, there would be no difficulty. It was.quite possible to comply with both regulations by slewing the front wheels of a car in such a manner that the car would run against the kerb if it moved. In the case of such a steep street as View street a motorist had no right to park his car if it would not stop on running against the kerb. In any hut the most precipitous streets the regulations could be observed.

Evidence was given by Inspector M'Nicoll, who-, stated that the wheels could he slewed whil the car was in motion, without straining the stccriiig gear. This was done in many steep streets, and was not too difficult an operation even for inexperienced drivers.

Mr Anderson asked for the dismissal of the cases; but this was refused by the magistrate, who stated that when the regulations were examined from a reasonable aspect there was- no inconsistency. It was incumbent on the users of parking areas on grades to make as little obstruction as possible, and the-method of parking had been provided for in the regulations. After hearing ths evidence of the inspector he was convinced that there should be no difficulty at all in obeying the by-law. The public was entitled to the use of the road, and owners of cars must see that they took up as little space as possible. The method outlined by the inspector was reasonable. The de-. fendants would be convicted.
