THE VALIDITY OF AN AGREEMENT. TO THE EDITOR. Sir, —May I ask your advice concerning the legality of an agreement drawn up between the Kaitangata Benefit Society and the South Otago Hospital Board? The agreement was made, for the purpose of providing hospital treatment to the members of the Kaitangata Benefit Society on tlic terms that each member should payhid per week to the Hospital Board. Prior to the taking of a ballot on the proposal, a copy of the proposed agreement was distributed among the members of the society. One clause reads: “If the agreement is signed by October 15, the South Otago Hospital Board agrees to cancel all outstanding debts.’’ As several of the members owed money to the Hospital Board, this was an incentive to vote for the agreement. The question is, Had the Hospital Board a right to make such an otter? Would it affect the validity of the agreement? 1 shall feel obliged if you will give your opinion.—l am, etc., Inquirer.
