BREACH OF CHARTER

In the Banco Court John White scoured a verdict for £1540 against Davis Gelatine, of Australasia, Ltd., for alleged breach of charter party. The plantin, who claimed £3500 damages, stated that it was agreed by the charter party that the defendants’ ship, the H. K. Hall, then at Lyttelton, should proceed to Malden Island to load a cargo of guano, which was to be taken to New Zealand and delivered on payment of the freight. 'Die allegation was that the defendant failed to carry out the agreement. The defendants pleaded that they did not agree as alleged and were prevented from carrying out the agreement by tha dangers and perils of the sea. A stay of proceedings was granted.
