JURY’S VERDICT UPSET. NO EVIDENCE OF NEGLIGENCE. (Pita United Prcsh Association.) CHRISTCHURCH, October 24. The verdict of the jury in awarding Robert Eagle £375 damages for injuries sustain’d by falling into a cellar in the Grand Picture Theatre was upset by Mr Justice Sim to-day. The judge said that the defendant’s duty to protect, the plaintiff did not extend to Lie, whole theatre, but only to ports to which the plaintiff might reasonably be expected to go in the belief that he was entitled or invited to go. The plaintiff ought to have realised when he opened the ooor and found the room in darkness that ho had no right to enter.
