BREAKAGE OF CROCKERY.
ACTION AGAINST SHIPPING COMPANY. JUDGMENT FOR DEFENDANTS. (Pee United Press Association.) AUCKLAND, June 25. The breaking of four casks of crockery, part of a consignment from Liverpool to Auckland per the steamer Middlesex in October last, according to the judgment of Mr Justice Stringer, was due to the peril of the sea, and not to improper stowage. The case arose out of an action by F. E. Jackson and 00. against the New Zealand Snipping Company. The plaintiffs, his Honor said, had failed to satisfactorily establish the onus put on them—namely, that the damage was due to improper stowage. Judgment was given for the defendants, with costs as per scale.
