MAGISTRATE’S COURT

Thursday, July 20. (Before Mr J. R. Bartholomew, S.Mfl) Undefended Cases.—Judgment was given for plaintiffs by default in the following coses:—Otago Daily Times Company v. Douglas Jones (Kaiapoi), claim £2 18s Cd, for subscription to Otago Witness (costs 8s); Jordan and Henaghan v. Wm. M. Harris, claim £l9 Is, for professional services costs (£2 14s); Harry Brady v. Jus. Edmund Hollands, claim £ll ss, for goods supplied (casta £2 14s); Colombo Tea Company v. J. and A. Grant (Nightcaps), claim £3O 4s 4d, for goods supplied (costs £4 Is 6J); Ezekiel Johns v. Norman Macdonald (Glenorchy), claim £7 19s 2d, for goods supplied (costs £2 8s 6d); H. E. Partridge and Co, v. John M'Nair (Rae’s Junction), claim £lB 19s sd, for goods supplied (costa £3 6s). Claim and Counter-claim. Albert Victor Grindley claimed from John Sydney Barton (formerly of Waimate) the sum of £l4 8s Gd for one truck of coal sold to the defendant.— The defendant submitted a counter-claim for £ls Is 6d, for board and residence supplied by the defendant to the plaintiff, for storage of the plaintiff’s oar, and for goods supplied to the plaintiff.—Mr Irwin appeared for the plaintiff, and Mr A. Duncan for the defendant.—Mr Irwin stated that the defendant’s evidence on the claim and also evidence on the counter-claim had been taken at Hangiora. The defendant admitted the claim, and all that he had to do was to call evidence against the counter-claim.—The plaintiff said that whenever he stayed at the defendant's hotel he always paid cash for his board and any goods he got from Iho defendant.—After hearing Mr Duncan, the magistrate said it could not be contended that the dotendant had saisfactorily proved his counter-claim. Judgment would be entered for the plaintiff on the claim, and the defendant would bo nonsuited on the counter-claim. Costa against the defendant amounted to £7 Bs.
