BOROUGH COUNCIL NOTICES. General assembly of new ZEALAND. SESSION 1922. 5n t'i matter of a Local Bill shortly intituled “The Mosgiel Borough Empowering Act, 1922.” NOTICE _IS HEREBY GIVEN that application is intended to be made to the ; General Assembly of New Zealand, at the present Session thereof, on behalf of the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Mosgiel, for leave to introduce a Bill intituled “An Act j to enable the Mosgiel Borough Council to acquire certain lands in the Borough of •Mosgiel and to sell er lease the same, and that the object which such Bill is intended to effect is as follows: To empower the Corporation, at any time or times, to purchase from the Otago Presbyterian Church Board of Property the whole or any part or parta of the parcels of land described in the Schedule hereto upon giving to the Church Board one calendar month’s previous notice m writing of the intention of the Corporation to do so; to provide that if the Church Board and the Corporation cannot agree as to the price the dispute shall be referred to the determination and award of two arbitrators or their umpire pursuant to “The Arbitration Act, 1908”; to provide that notwithstanding the giving of any such notice or the making of any agreement or award fixing such price the Corporation shall not be bound to complete the purchase unless and until the Council of the Borough shall obtain the consent of the Ratepayers to borrow all moneys required in connection therewith; to provide that if the Corporation shall obtain such consent and shall give to the Church Board, within six calendar months after the price shall have been agreed upon or fixed, notice in writing of the Corporation’s intention to complete the purchase the Church Board shall upon payment of the purchase money convey or transfer such lands to the Corporation subject to existing tenancies; to empower the Corporation to subdivide such lands and to lay off streets therein and to sell such lands, either altogether or m lots, by public auction or private contract, at such prices and upon ' such conditions as the Corporation shall think fit, or to lease such lands, at such rents, for such terms, and subject to such conditions as .to the Corporation shall seem meet, and to execute all necessary documents; to provide that a recital m any Conveyance or Transfer of such lands to the effect that the sale is made in pursuance of the provisions of the Act shall be conclusive evidotoe that such sale is lawful; to provide that every Agreement, Conveyance, or Transfer from the Church Board to the Corporation shall be exempt from Stamp Duty; 1o empower the Corporation (with Ihe consent _of the Ratepayers previously obtained in the manner prescribed by “The Local Bodies’ Loans Act, 1913”) to borrow nil moneys required in connection with the purchase, subdivision, and sale of such lands. THE SCHEDULE.. ALL THAT parcel of land, containing 154 acres more or less, being Sections 4 and 5 and part of Section 6, Block VI, East Taieri District. All those parcels of land containing together 95 acres 3 roods 27 poles, more or loss, being Allotments 1 to 15, parts of Allotments 16 to 21. and Allotments 22 to 30, Township of Stuart Town, being a subdivision of Section? 23, 24, and 384 b, Irregular Block, East Taieri District. AND NOTICE IS HEREBY FURTHER GIVEN that a copy of the said Bill and a Plan of the said parcels of land have been deposited at the Magistrate’s Court at Mosgiel, and remain there OPEN TO PUBLIC INSPECTION for a period of three weeks from the date hereof.
