J 879 A TEAR FOR THREE HOURS’ OVERTIME. A King’s Bench Divisional Court, construing of the Lord Chief Justice, Baron Trovethin, and Justices Sankey end Branson, held that a retired policeman, Albert Henry Green; was entitled to benefit by a sum o££79 a year because he remained on- duty for a few hours after the actual date of his retirement from the force oh pension. Mx Groom-Johnson, for, Greta, said that the Gloucestershire Standing Joint,Committee, which had employed him as constable ' for 29 years, decided to retire him on March 31, 19X9. Hie pension then would , have- been £B6, but he was on, dock duty until 3 am. on April 1, and travelled on duty to Cheltenham to get his discharge on that day. In view of the recommendations of Lord Deeborough's Committee, which awarded higher police pensions as from April I, 1919, the day' Green" actually retired, he ought to re-' oeive a pension of* £165. M r Barringtoh-Ward, K.C., for the Gloucestershire poHoe . authorities, argued that Green’ was retired by his superior officers on Maxch ai. The. Lord Chief Justice asked; What was Green during- the three hours he was on duty in the early hours of April 17 Mir Barrington-Ward: A psuedo-polioamau. He was at work by accident whoa really he should have' been in bed.—(Laughter.) -, Giving the judgment of the court in favour of GVeen, with costs, the Lord Chief -Justice said he really should not get the increased pension, but under the Statute and the facts he was entitled to it. It was a lamentable thing, but it was a windfall, and his Lordship could not .see; how Green legally could be deprived of it. '
