WELLINGTON, July 25. The Court of Appeal delivered their reserved judgment tins morning in the case Pc-jry v. the Commissioner of Stamps. The Court unanimously held that the deed of settlement created a valid trust, and as it was made without consideration it amounted to a gift within the meaning of part 4 of the Death Duties Act, 1909; also that the duty as asstesed bv the Commissioner was correct. The appeal was therefore dismissed, but as the point upon which assessment was upheld was not raised by the Commissioner no costs were allowed.
