It sometimes happens that a statute lias been an force for many years before a judicial interpretation is asked for in respect of a certain clause which it embodies. Although the act has been [ in operation for 25 years this is the first i time that this clauss has cropped up in i a court of law in Xew Zealand, and possibly j anywhere else. The circumstances of the ! c3:o were that James M'Dousall, hotel- j keeper, leased from W. J. Mofiett. of In-vcrcnrg-ill. merchant, the Royal Mai] Hotel at, Ltimsdcn, one of the provisions of tho lease being that on the bankruptcy of the lessee the lessor should have the right to determine the 1«lvc. The lease was mortgaged, with the consent of Motfett, by M'Dotigall to I'. .1. Rodgers, w!io subsequently assigned the mortgage to William Miller, of Dunedin, commission agent, On

the 6t.lt of November M'Dougall was adjudged a bankrupt, ami on the. 12th of November MofToft gave notice determining the lease. Mr Miller claimed that though Uie lessee had made default in the lease by becoming a bankrupt, yet the lessor could not obtain (wssession of the premises and put an end to the- lease as against the mortice, Mr Miller. Mr Solomon, K.C., vii'h Mr W. 1,. Moore, appeared for tho l'ljiuitiff, and Mr \ raY « for the defendant. After legal argument his Honor .Mr Justice Williams mtimakd that, as the point was now ami the amount involved was SOUie- ™« large, ho would take ti.no to conewer li-.s decision.

During tho past week tho number of pnlicnWin the Hospital has been reduced from 13* to 127. Tho admissions were 33, the discharges 37, and threo patients named John Scott, Mary Annan, and Elizabeth llitchcox died.

The collcc'ing boxes in Saturday's venture wcro cleared three times during the day, and a. small committee was busy all the afternoon carrying bags of coin to the National Hank. Here, from 2 o'clock p.m. to midnight, the building resounded with the clank of disturbed metal. A largo staff of tellers—for practically every man of the bank's staff had given up his half-holiday and returned to tho building in order to assist in the good cause—received the heavy hags as they came in, and proceeded, with wonderful quickness and oxperlnes-s, to sort. their contents into little methodical heaps. The coin from each station was counted up and tabulated; and so well had Mr R. Martin organised things (hat when, just before midnight, tho last bags were sorted lie was able to give in detail the numbers of different coins that had ken received. Tho association officials have repeatedly (dated that, they are under a great debt, of gratitude to the members of the bank staff, for thoy have undoubtedly in doing this work taken a very heavy task off the shoulders of tlio executive.

On Saturday afternoon the president: of the Hospital Saturday 'Association received tho following wire from Mr James Ward (president of the Invereargill Hospital Saturday Association):—" Our association trusts your efforts will be literally aosjxmdcd to, and result in a record collection."

When the Hospital Saturday collection boxes were emptied on tho bank counters somo queer things came to light. Mostconspicuous of all was a. collection of washers, evidently tho gifts of a party of young humourists from some of the engineering 6hops of the city. There were also buttons of many varieties, old stamps, the butt-cml of postal notes, old medals, (squashed coins, pieces of tin, and in one case a silvered halfpenny, which might easily have passed for a shilling.

Nurse.? from the Duncdin Hospital visited the University ami Otngo Tennis Courts, where matches were in progress, and the Dunediu Bowling Green in furtherance of the Hospital Satuday campaign. Tlipy wore kindly received, and their boxes benefited accordingly. During the, day, by motor and buggy, representatives of the executive visited nil the suburban collecting stations, ami helped, where, possible, in the good work. Mr W. T. MTarlanc, Mayor of St. Kilda, who took a keen interest in the work of organisation in Hie south part, of the town, was unfortunately prevented by illness from tukinjr an active part in tho collection.

At the inquest at Auckland on Arnold Gilmore, who died in the hospital as tho result of injuries sustained by a lift accident, ihe jury found that death was tiro result of injuries sustained through the neglect of Edgar Barker, who, according to tho evidence, was alleged to have given word to Gilmore that all was safe as the deceased Marled Iho cage. Tho coroner Raid this amounted to a verdict of manslaughter against Barker.

A most pleasing feature of Saturday's arduous collecting work was the fad that tho ladies almost invariably received kind and courteous treatment at tho hands of the various individuals they approached; and they, on their part, never overstepped the founds of propriety, and if iomowhat insistent never pushed their demands beyond tho limit of good taste. In this respect they received n, compliment from a visitor to Dunediu, who had experienced other collections. Ho said that for ladylike aggro.ssirencM and e-ood business capacity lie gavo the ladies of Uunodiu the palm. "The Indies of are too rough," he said.

The plethora of "coppers" on Saturday in connection with Iho Hospital collection led io tho jierpetration of a rather neat joke on the part of a "stolid" policeman. "Just a penny, please!" became a sort of battle-cry of the collector during the day. and, finding men so susceptible, one bold lady decided to l ry it on a policeman. "Please give us a copper" she beipvd nnd held Iho box out. in a line with "his third tunic button. The big guardian of Ihe peace eyed (lie fox and tho l;cgnr "Gladly." he said; "gladly. lint, teiTme -bow am I going to get into that little box';"
