Edge and another.—Motion for declaration that the decision previously given negativing the right, of. the lessee, under lease in perpetuity, to mine for coal was bused on tlio assumption that tho coal mino had been oponed-prior to tho granting of the lease Mr Hosking, K. 0., and Mr Stephens appeared herein.—Declaration accordingly. Stewart for the beneficiaries.—li was suggested that 5 per cent, should to allowed the executors on the free assets, and. his' Honor approved of this, and allowed U per cent, on tho insurance rnoiiey, amounting to £256. Costs one guinea. CRIMINAL CALENDAR. j The following is the list of cases to come before the Supreme Court at the criminal sittings, commencing on Monday: — Frank Corbett, alias William Brooks, forgery at Hyde. William Johnston Kae, eheop-stealing, Balclutha district, Answorfb Livingstone Perry, theft from a dwelling at Dunedin. There is a. second charge of breaking and entering and theft at Dunedin, and a third charge of theft from a dwelling at Dunedin. John Healey, Ernest Burgess, and Edward Pyle, assault at Dunedin. Two or three prisoners have also to como before his Honor for sentence. AUCKLAND, November. 19. At the Supreme Court to-day Mark Meuzies, a coloured man, was found guilty of assault upon a girl of eight yeare of age. Sentence was deferred. Richard John Yeoman was also found guilty on two charges of assault upon littlo girls, and sentence was deferred in this' ca&3 also. At the Supreme Court to-day a young maried couple named Moyes " were acquitted on. a charge of having made a false declaration under the Marriage Act in stating that the female accused was of a legal marriageable age. There was some applause in court when lie jury's vtrdict was announced, but it was quickly suppressed. LET IT BE KNOWN.
