CLAIM AGAINST A DENTIST
WRONGFUL EXTRACTION OF TEETH. . (Pkr Uxitzd Pekss Association,) _ ASHBUIITON, September 6. Judgment waa delivered here to*day in tho caso of Alice Mary, Voyoo v. A. L, Zo'uoh dentist, a claim for £100 for tho wrongful extraction of two teeth. The plaintiff is q, ; girj • betwoen six and seven of, age, and was taken by her mother to Zouoli s .surgery to get two mill; teeth extracted, so that two permanent tooth would have room to' grow. The two permanent teeth were extracted instead of tho milk teeth. Judgment was given for £50 mid oosts. An application for a rehearing was made. . At tho lvoaring boforo Mr Day, S.M.. !*" ll! J rvoy (for. the defence) submitted that boforo plaintiff could succeed it would havo to bo shown that as a. dentist his client had committed a negligent act. Ho had gained nothinc by IJIO act, and tho extraction bad been cfTcoted at tho distinct instruction of tho child's mother. Mr 1-liLrpor (for tho plaintiff)' contended that tho dentist, being s in tho samo position as nwheal man, and presumed lo havo ckill. was in duty bound to refuse to tako ;tho tooth out, ovon at the request of tho mother, unless vory strong reasons wero given.
