In 1903—the second flood in particular—the whole of witness's part of the Education reserve on the west side was submerged. He was positive that this was not the case in 190-t.

By Mr Fra.=er: Witness was at the dam on tho evening of April 21, immediately after Mr John MacGregor left. The water was then 6in from the top.

By Mi M?.cGrogor: Witness suffered from the flood of ISM to the extent of a third of the damegc he suffered in 1903. Had there been only one flood in 1903, witness would still claim tho amount of compensation he was claiming now. "With the condition? obtaining in September, 1903, he considered the laud was quite liable to three floods. Witness reiterated liis evidence on many points of faol and detail. Alexander Moynihan also gave evidence at great length corroborative of evidence already given as to last week's flcod and the inspection niado by claimants and Mr Stark on Sunday las'. The court adjourned till 10.30 a.m. to-day.
