Tho plans and ctoss sections showing the nature of the works proposed to be undertaken aro deposited for public inspection in tho offico of the Local Authority, being the office of the Borough Council, situate in the Town Hall Buildings, Hillside road, St. Kilda aforesaid. DELEGATION. It is intended that the authority conferral by the Order-in-Council shall bo delegated by the Local Authority to the Mavor, Councillors, and Citizens of the Citv of Dunedin (hereinafter called "The City Corporation"), and tho following is a general description of the terms and conditions, subject to which such delegation is to bo made—that is to say: 1. Term of delegation to be <!2 years. 2. Rent for first 21 years to be £8 Gs Sd per annum; and for balance of term, as agreed between the Local Authority and the City Corportion; and, failing such agreement, to bo settled by arbitration. It. The City Corporation to keep the roadway between flic rails and for 18in on each outel, 1 side of, the rail in good and substantial repair to the satisfaction of the borongh surveyor. 4. That unless the City Corporation shall first complete and open for traffic the line along the ronto thirdly doscribed, tho City Corporation is to commence the construction of such !:iuo immediately after the completion of tho lino along tho route first doscribed, and shall thereafter continuo the construction of such first-mentioned line without interruption and with businesslike speed until the samo shall have been completed and opened for traffic. 5. The City Corporation is to be entitled during the first 21 years of the said term to charge and receive for the use of the said tramways the tolls and charges hcreinbeforo specified, and during the remainder of the said term is to be entitled to receive such tolls and charges as may be agreed upon between the Local Authority and tho City Corporation; and if no such agreement shall' Iwyo boon made before tho expiration of the twenty-first year of tho said term, then such tolls and charges as shall bo determined by arbitration; and the City Corporation is not to charge or receive toils or charges exceeding the scale for the time being in force: Provided always that, in tho evont of the Arbitration Court granting extra wages to employees on Sundays and holidays, an increase in fares proportionate to such extra, wages may be charged by the City Corporation, tho amount thereof to be settled by agreement between tho City Corporation and the Local Authority, and, failing such agreement, by arbitration. 6. If the net profits derived from the working of that part of tho tramway system for tho time being in use during any year, commencing from the date on which the said lines or any of them or any part thereof respectively shall bo opened and used for traffic, shall amount to £8 per centum on tho moneys for the time being expended by tho City Corporation in tho construction thereof and the plant therefor, then tho City Corporation during tho next following year is to sell to passengers throughout the tramway system tickets conferring the right to 14 penny rides in any tram car (not being a special car as hereinbefore mentioned) for the sum of ono shilling. And for tho purposo of ascertaining the said net profits there shall bo deducted from the grOB3 returns from the working of the tramway Bysiem the cost of tho working expenses and maintenance thereof, it being intended that such net profits of £& per centum as aforesaid shall provide for interest, sinking and renewal fund, and reduction of goodwill in connection with tho tramway system. 7. The Local Authority is to have power, on tho determination of the term, to purchase at a valuation the said lines of tramway, and such of the stations, lands, and buildings, engines, machinery, cars, and plant of every kind and description within the Borough belonging thereto or used therewith as shall bo reasonably necessary [or the working of tho said lines of tramwaj - , but not including goodwill. 8. In dofault of purchase at the end of the term a valuation is to bo made of the said lines of tramway and premises, including goodwill, and a grant of the like privileges as aro now proposed to be granted for a term of 21 years is to bo put up to public auction at the upset prico of tile annual rent for tho last 21 yeaTs of the term now proposed to be granted, subject to tho payment by tho purchaser of tho amount of the said valuation; and, failing any purchase at such sale, the City Corporation is to enter into an agreement to continue the undertaking for a further term of 21 years at tho same rent. 9. Tho Local Authority is not itself to construct or to grant the right to construct tramways along any of the routes hereinbefore mentioned, except Kennedy road, in the event of the City Corporation not constructing the lino along that routo, or along any other route in tho Borough crossing tho tramways of tho City Corporation and comneting therewith.
