. THE SEAMEN'S DISPUTE. THE COURT DELIVERS THE AWARD. Tho Arbitration Court sat in tho old Supreme Court yesterday morning to deliver its award m the Seamen's dispute. His Honor Mr Justice Cooper presided, supported by Mr R, Slater and Mr S. Brown. Mr W. Belcher appeared for tho Seamen's Union, and Messrs C. Holdsworth and P. J. Kirby appeared for the Union Steam Ship Company. Tile claims now made by the seamen wero very carefully and fully inquired into bv this court at tho former hearing, and a majority ot the court consider that in tho present dispute •?, co , urt , ""e ll4 n() t to substantially interfere ■with the last award. " f. r . Slater does not agree with Hub view, anu thinks that tho increase of 10s should be granted.

As regards the question ol banked fires, anchor, watches, and seven-bell meals, the court ore of opinion that it would be unwi6e, as well as dangerous, to interfere with the discretion of tho responsible officers of the steamships in the regulation of these or any similar matters ■which relato to tho precautions which these officers may from time to timo think it necessary to take in regard to the safety or management of tho ship, anil liavo in effect substantially continued the provisions of the former award. We have made.somo provisions for tho payment of overtime to men who aro called iroro their watch below to discharge ashes, and nave extended the provisions of clause 20 of the Wellington award of 1899 to boats engaged Jri the Wcstport coal trade, and have also made a'slight alteration in the payment of overtime to men engaged on excursions on stated holidays, and have added Boxing Day and Easter Monday to such holidays. . "With regard to the questions of preference' and the demand of the unions for power to their representatives to visit the vessels, both these matters havp been twico fullv considered by this court-in 1897 by tho court ur.dertho presidency of Mr Justico .Williams, and in 1E99 undor the presidency of Mr Justice Edwards,— and a majority of the court at the present hearing ace no reason to differ from the decisions of this court on those occasions.

"The Court o{ Arbitration of New Zealand (hereinafter called 'tho court'), having taken into consideration the matter of tho abovementioned dispute, and having heard tlie uhidrt by its representatives duly appointed, nnd having also lieard such of tho employers as were represented either in person Or by their representatives duly appointed, and ' having also heard the witnesses tailed and examined and OOS3-exaniined by and on behalf of the said parties respectively, doth hereby order and award: That, ob between tho union and the. members thereof and tho employers nnd each and every of them, the terms, conditions, and. provisions sot out in the Schedule hereto and' of this award, shall be binding upon the union and upon every member thereof and upon the employers and upon each snd every of them, and that the said terms, conditions, and'provisions shall be deemed to be and they are hereby incorporated in and declared to form part of this award; and, further, that tho union and every member thereof, and the employers and each and every of them, shall respectively do, observe, and petforui every matter and thine by this award and by the said terms, conditions, and provisions respectively required to be done, and shall not do anything In contravention of this award or of the said terms, conditions, and provisions,, but shall in all respects abide by, observe, mid perform tho same.' And the court doth hereby farther award, order, and declare that any breach oT the said terms, conditions, nnd provisions set out in the schedule hereto Blinlf constitute a breach of this award, and that the sum of £100 Bha'l be the maximum penalty payabl© by any party or person in respect thereof. And the court doth further order thnt this award shall cpme into operation on the first day of August, 3303, and shall continue in force until the 31st day of December, 1903.

The provisions of the above award and the provisions and conditions contained in this schedule ahill bind the shipowners respectively in so fat only as respects ships owned or chartered by them respectively which trade within the limits of tho industrial district of Otago and Southland, or which trade in some trade one of the terminal ports of which is Yfithin the limits of the said industrial district.^

port of discharge in the colony, consequent on tho completion of a round voyage, by 21 hours' notice on cither side, all notices to bogiven to or received from tho master of tho ship only. Any man discharged at any place other than the port at which the articles oro drawn out shall be given a passago back by tho first vessel proceeding to tho home port or to the place at whioh the man shipped. "No Discrimination Against Unionists. " 42. Shipowners in employing labour shall not discriminate against members of the union, and shall not in the engagement or dismissal of men, or in the conduct of their business, do anything directly or indirectly for the' purpose of injuring tho union. When members of tho Anion and nonmembers aro tonuloyed together, there shall be no distinction between them, and both shall work together in harmony and under the same conditions, and shall rcceive equal pay for equal work.
