THE MYERS FRAUDS.

WELLINGTON, September 8.
One outcome of the Myers case was before tlie Supreme Court to-day,-when Victor Harris, of Christchurch, sued Mrs P. Aldons for the recovery of £200, the balance of tlie amount due on a promissory note signed by Joseph Myers and endorsed by Mrs P. Aldons. The defence was that the note was obtained by a friend. There was a counter-claim by Mrs Aldons for the repayment to her of £200, which she had paid for this particular bill. The .issues put to the jury and their answers ' thereto were as follows: — (1). Was' defendant induced to endorse the note through, the fraudulent misrepresentation-: of Joseph. Myers?—No. (2) Had plaintiff, any notice of such fraudulent misrepresentation'?— Yes. (3) Was any valuable consideration ;,igiven by Joseph Myers to defendant for endorsing the note, and, if an}-, what? (Left to the court). (4) Did plaintiff give' any valuable consideration to Joseph Myers for the promissory note? (Left tot-he court.) (5) Did plaintiff take the. promissory note, in good faith?— No. (6) Was there any agreement or understanding between plaintiff and Joseph Myers that if Myers gave him the note lie would not prosecute him for'perjury?— Yes. (7) Was defendant^ aware of the forgery or the O'Connell bills when she paid 'the £200 to plaintiff?— No. , (8) What sum, if any, is plaintiff, entitled to recover? (Left to the- court.) ' (9) What amount of interest is plaintiff entitled to recover?— None. , The case was then reserved for argument on the law points.
