WELLINGTON, April 16. The case in which the Marine department seeks to force Captain Jones to give up his certificate as a Home trader comes on on Monday. Prominent authorities agree that the contention that the Supreme Court has no authority or jurisdiction to deal with the case will probably prove fatal. The portion of the affidavit" of Captain Jones, in whicli he states that the Hon. Hall-Jones expressly authorised and directed that the defendant should be allowed to present himself for examination is a peg upon which some very interesting evidence is likely to be hung, provided the prosecution is not quashed on the law point straight away. I am informed that Mr Hall-Jones intends making an affidavit that the pencilled memo, which the officials of the department took as an instruction to proceed with the examination, notwithstanding that it was irregular for them so to proceed, ivas merely a jotting for his own guidance, and was not meant for an official instruction. Some very interesting developments may confidently be expected on the result of that point of view also.
