(Before his Honor Mr Justice Williams.) JAMES CAGNEV AND JAMES BRKEN V. ELLEN

CONLIN, EDWARD CONLIN, AND OTHERS An action brought by the executors to decide the interpretation of a will to obtain the judgment of the court »s to who are the persons beneficially intere3t«d, their shares, interests, &c. Mr Allan Holmes appeared for the plaintiffs, the Hon. J. MacGregur for the defendant Edward Oonliu, and Mr C. SI. Mouat for the infant defendants.

The matter was argued on the will and authorities, no evidence beicg called, and at the conclusion of the argument His Honor delivered judgment, making an order (1) declaring th« children to be entitled in equalsharessubiect ooprovision for maintenance for ,the wife duno- her lifetime, and to the brother so long as &e remains unmarried, the matter to be referred to the registrar to inquire and report as to what are reasonable sums to be allowed for such maintenance. (2) The plaintiffs (the executors) may carry oil the business of the testator until further order. (3) That the trustees may apply to the maintenance and education of the children of the testator during their minority such parts of the income of their respective shares as the trustees may think proper; and the trustees may either apply euch sums themselves or pay the same to the widow during her liff, and thereafter to the guardian or uuardians without seeing to the application thereof.

Mr Allan Holmes appeared for the petitioner to move for the decree abiselute. Neither respondent nor co-respondent appeared or were represented by counsel.

His Honor said the evidence on the documents before the court appeared to be satisfactory, and granted the order for ihe decree absolute.
