J. M. Brown v. Reunert and Co.—Claim. £16 53 Bd, amount due" for commission and travelling expenses.—Mr Thornton appeared for the plaintiff, and Mr B. A. Joel for defendants.—ln this case, which was heard on Monday last, his Worship gave judgment as follows :—" The first item in the claim is for' remuneration for a week's services as clerk. No arrangement was made as to payment prior to the services being rendered. Mr Brown says his charge of £3 is fair and reasonable, and that he never agreed to accept less. On the other side, Mr Reunert has sworn that a claim wa3 made for £3. He disputed theamount with Mr Brown and offered to pay him £% and Mr Brown agreed to accept that amount. Mr Carden's evidence is to the same effect. The evidence on this item is in favour of defendants. The other disputes between the parties aro mainly respecting the terms upon, which it was agreed that plaintiff should travel for defendants. On the one side there is the unsupported evidence of the plamtiit against that of the defendants, corroborated by Mr Garden, and I see nothing unreasonable or improbable in their evidence.
