It? was ord-.red to pay the amount in monthly instalments of £2 each, or iv default, 14 days' imprisonment. (diver and Ulph v. Ch. Miller.—Claim of £10 ICs 7d. Judgment, with cr-sta, Louisa M'Kay v. John Barton.—Claim of £7 6< ml, for goods supplied. Adjourned till the; next clay; Win. Asher v. Thomas G. Fife.—Claim of £13 lGs 2d, for timber supplied. Judgment for plaintiff, with costs. 11. Andrews v. Guthrieand Others.—This case was heard on .Wednesday last, liis Worship now delivered judgment as follows : —The evidence in this cu.se between the plaintiff and Hannah, one of the defendants, is very contradictory. It is highly improbable that thd plaintiff and the witness Miller could have concocted such a conversation as that which they allege took place at Callia's Hiver. If such a conversation took place, and 1 believe it did, then it appears evidtnt that the damage to the goods in question arose through the neglect or default of the master, and not from any of the dangers and accidents of the seas, for which the master would not be held liable. The fact of the master having actually put back to take in more ballast materially confirms the statement of the plaintiff, a:id in a corresponding degree wealceus that of the defendant Hannah. The value of the goods damaged was not disputed. I think that the yUiiutiff is entitled to recover the amount sued for. Judgment for plaintiff—£29 4s 2d, and costs. The Court then adjonrnei'..
