Wellington", May Bth. The Court of Appeal opened this morning, the Chief Justice and Justices Gillies and Williams on the Bench. The Court has beetf occupied all day in hearing the case Brogden v. Queen, an action brought to recover a Jarge sum of money for breach of contract, The question at issue is whether General Government had a right to deduct certain sums of money from Brogden and Sons, railway contractors, for passages of immigrants brought out to the Colony for Brogdens' convenience. MrTravers appeared for the plaintiff, and Messrs Gordon, Allan, and Bell for defendant. - - - Atjcklabd, May Bth. The three Commissioners arrived by the Hawea, and waited on the Superintendent this morning. He gave them a letter, in which he set forth his reasons for not recog- ' nising their rip,ht to make application, the main one being that they had no legal standing. He also addressed a letter to the Provincial Auditor, pointing out his legal powers, and instructing him not to give pny information other than that which the law compelled. Gbahamstown, May Bth. A fire occurred last night under suspicious circumstances at the Court House Hotel, which is at present unoccupied. It was ox tinguished promptly. The house was insured in the Norwich Uuion for £300. AUSTRALIAN CABLE NEWS. Sydney, May Bth. Heavy rain has been falling all over the Colony for the past two days. Melbourne, May Bth. Another seizure has been made of Stevenson's goods, being importations containing hosiery not mentioned in the invoices. The miners near Tarnagulla are petitioning to prevent the further spread of Chinese on the goldfield. SPECIAL TELEGRAM. (from opb own correspondent.) ' Palmbrston, May Bth. : , At 4 o'clock on Sunday morring, at Flag Swamp, D. Sutherland's sacks of grain, worth £163, were burnt. Luckily 40 had been sent away on the previous day. They were not insured. At 6 a.m., £150 worth of wheat and oats, the property of Mr Galbraitb, Flag Swamp, was burned* The loss ia partly, covered by insurance. i At 6 o'clock in the evening; two stacks of wheat, belonging to Mr Murdoch, KM., were burned.
