. .. ~ i Fair ay, 17th December. (Before John Bathgate, Esq., B.M. Talbot t. Greenwood.—This was a judgment summons. The defendant was allowed a month to pay the debt. Shotover Terrace Goldmining Company y, Thomas Sirman."—Claim of LI ss, calls. Mr Sinclair appeared for the plaintiffs, for whom judgment was given, with costs. Judgment went for the plaintiffs, with costs, in the following cases : —Muir v. Herbert Lilichop, goods supplied, L 2 17s 6d: Herbert, Haynes, and Gc. v. Haines, goods supplied, Ll6 7s. George Munro v. Chase (widow of the late Francis J. Chase). —Claim of L2O, damages for alleged removal of gorse fence in York place. MrF. K. Chapman appeared for the plaintiff. Mr Stout, who defended, pleaded not guilty and no jurisdiction. The evidence went to show that the gorse fence was on the boundary line between the property of the litigants, and that the fence had been simply trimmed in the usual way last August. It was rumoured that the present City Surveyor's bench marks made some properties four feet out in the South end of the city. One survey showed that in ihe present instance there was a question of title. He (Mr Stout) presumed that when the City was laid off at tirst through the dense bush and uneven ground, they could not lay it- off accurately. The surveys differed to the extent of four feet in Maitland street. The recent survey of the city interfered with the existing boundaries. Plans were produced by Messrs Dun can and G. M. Barr. His Worship thought the Council should have a clause introduced into the new Act declaring the existing boundaries legally accurate. Francis Battson deposed that the gorse hedge was erected some 16 years ago on what was supposed to be the boundary line. The defendant had been in possession of the land since then and trimmed the beige when necessary, Francis John Chase, the defendant's son, deposed that he had planted the hedge. The case was adjourned until Wednesday, the 22nd mat., in order to allow the City Surveyor (Mr Mirams) to give evidence. '
