RESIDENT MAGISTRATE'S COURT,

Wkdnesday, 30th June. I (Before J. Bathgate, Esq., It.M.) \ A. and T. Burt v. Alex. Muir.—This was an application for a judgment summons (£1 3s Gd), under the Abolition of Imprisonment for Debt Act, 1874. The defendant residing in Canterbury, the application was necessary in open Court, and it was granted at the plaintiffs' risk. Edward Moss v. James H. Bacon.—Claim of LlO 11s (id, furnishings supplied and work done. Mr Joyce appeared for the (ilantiff, and Mr E. Cook for the defendant. After hearing the evidence, His Worship gave judgment for the plaintiff for LC 10s, with costs. Allen v. Guthrie, Hose, and Adams.—Claim of LIQO for trespass. His Worship delivered judgment in this ease as follows:—I have given this case careful consideration, and am of opinion that the defendant, Guthrio, is liable in the sum of 20s for trespass. I have more difficulty with the other defendants. There is no doubt that they carried out the orders of their master in an improper manner, and damaged j the plaintiffs goods. The contents of the tubs must be paid for, and a moderate amount for damages to the dresses and feathers. The ] ilaiutiff assesses his damages at LS3; I think this is extravagant, and I may state that the weak point of the plaintiff's case is this : While he had every opportunity for exhibiting the injury to the dresses by experts, and might have produced them in Court, we have no satisfactory evidence of. the damage to the dresses, feathers, or other goods, except by his own testimony. While he had an opportunity of supporting his own testimony by that of experts, he appears to have neglected this, and thereby raised a doubt against himself. I think the sum of L2O, in the circumstances, a suf fieient allowance for the loss incurred. Judgment for the plaintiff for'2os against Guthrie, and for L2O against Eose and Adams, with costs. The Court adjourned till Friday next.
